Welcome to Little Wonder. These Terms of Service ("Terms") govern your access to and use of the Little Wonder website, store, products, and services (collectively, the "Services"). By accessing or using the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Please read these Terms carefully. They include important information about your legal rights, remedies, and obligations.

About Us

Little Wonder is a New Zealand-based business that sells jade jewelry. Our Services are operated by Little Wonder and powered by Shopify. References to "we," "us," and "our" mean Little Wonder.

Eligibility

By using the Services, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a binding contract. If you are using the Services on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

You may need to create an account to access certain features of the Services. When you create an account, you agree to:

• Keep your account credentials confidential and secure.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate your account at our discretion, including if we suspect fraud, abuse, or a violation of these Terms.

Products and Availability

We do our best to display our products accurately, including colors, ingredients, packaging, and descriptions. However, actual products may vary slightly from the images or descriptions shown on the Services due to display settings, product updates, or supply variation.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse or cancel any order at our discretion, including for reasons such as pricing errors, suspected fraud, or ordering restrictions.

Product Use and Safety

Stone pieces vary in colour, pattern and translucency from piece to piece. This variation is not a defect. Photos are a guide and can look different on different screens.

Promotional offer. The buy one, get one 50% off offer applies automatically when two eligible pieces are in your cart. The lower-priced piece receives the discount.

We make no claim that our products treat, cure, or prevent any disease or medical condition. Statements about our products have not been evaluated by the FDA or any other regulatory body unless expressly stated.

Pricing and Payment

All prices are listed in the currency shown at checkout and are subject to change without notice. You are responsible for any applicable taxes, duties, or shipping charges, which will be calculated at checkout where applicable.

By providing payment information, you represent that you are authorized to use the payment method and authorize us (and our payment processors) to charge the full amount to that payment method. If a payment fails or is reversed, we may cancel your order or suspend your account.

We use third-party payment processors to handle transactions and do not store full payment card details on our systems.

Orders and Order Acceptance

Placing an order constitutes an offer to purchase. Your order is not accepted until we send you an order confirmation. We reserve the right to accept, decline, or cancel any order for any reason, including pricing errors, product unavailability, suspected fraud, or shipping restrictions.

If we cancel an order after you have been charged, we will refund the amount charged to your original payment method.

Shipping and Delivery

Shipping timeframes, methods, and costs are described on our Shipping Policy page. Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control.

Returns and Refunds

Our Refund and Return Policy is incorporated into these Terms by reference. Please review it for details on eligibility, timeframes, and how to request a refund or return.

Subscriptions

If you sign up for a subscription order, you authorize us to automatically charge your payment method on the recurring schedule you selected until you cancel. You can pause, skip, or cancel your subscription at any time through your account. To avoid being charged for an upcoming shipment, make changes at least 24 hours before your renewal date.

We may update subscription pricing with notice. Continued use of the subscription after a price change constitutes acceptance of the new price.

Promotions and Discount Codes

Promotions, discount codes, and offers are subject to their own terms, may have expiry dates or usage limits, cannot be combined unless expressly stated, and may be withdrawn or amended at our discretion. Discount codes have no cash value and cannot be applied retroactively to previous orders.

Intellectual Property

All content on the Services, including the Little Wonder name, logo, product designs, packaging, images, text, graphics, and other materials, is owned by or licensed to Little Wonder and is protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, or create derivative works from any content on the Services without our prior written permission, except for personal, non-commercial use consistent with these Terms.

User Content

If you submit reviews, comments, photos, or other content to the Services or to our social media, you grant Little Wonder a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, and display that content in connection with our business, including in marketing and advertising.

You represent that any content you submit is your own, does not infringe anyone else's rights, and does not violate any law. We reserve the right to remove user content at our discretion.

Prohibited Conduct

When using the Services, you agree not to:

• Use the Services in any way that violates applicable law or these Terms.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services, our systems, or any related networks.
• Use bots, scrapers, or other automated tools to access or extract data from the Services without our written permission.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Submit false, misleading, or fraudulent information (including chargeback fraud or fake reviews).
• Resell, redistribute, or use our products for commercial purposes without written authorization.

This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any content or product information is accurate, complete, or current.

Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees that cannot be excluded under applicable law.

Limitation of Liability

To the fullest extent permitted by law, Little Wonder and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services or products.

Our total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to us in the 6 months preceding the event giving rise to the claim, or USD $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Little Wonder and its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. On termination, provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will remain in effect.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our practices or for legal, operational, or regulatory reasons. We will post the revised Terms on this website and update the "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing Law and Disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of New Zealand, without regard to conflict of law principles. You agree that any dispute will be resolved in the courts of New Zealand, unless applicable consumer protection law in your jurisdiction gives you the right to bring proceedings in your local courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy, Refund and Return Policy, Shipping Policy, and any other policies referenced on our website, constitute the entire agreement between you and Little Wonder regarding the Services.
